Question: We have a business customer who admits that he was aware of fraudulent activity carried out by his bookkeeper, however, he did nothing and allowed her to remain on staff. He has finally terminated employment and has brought 5 "forged" checks issued in the past 60 days asking us to prepare forgery affidavits and return app $3200 to him. He is also filing charges against the employee with the police department. I know that the UCC was revised to where the customer is also considered negligent if they do nothing to prevent the fraud. What is our liability to this customer?

The intermediate- to long-end of the Treasury yield curve rallied…the yield on the 10Yr Treasury Note fell 9bps to a 4-week low of 3.84% and the 2Yr Note fell 12bps to 2.38%. Crude oil continues to fall, down 3.1% since Friday's close to $111.80/bbl. Other news this week included the expected drop in retail sales as the automotive industry continues to get hit hard from high gasoline prices, tightening credit standards and even decreasing residual value adjustments for leased cars.
