Question:   We have a customer who is a student (law student).  He called the bank the other day and stated that he mailed a post dated check to someone and if we allowed that item to clear his account before the date on the check, we would be liable for the funds coming out of his account.  He stated that he just learned in a class of his that if he gave the bank notice of this check, we were accountable if we allowed the item to clear his account before the date on the check.
     Can you shed some light on this and give us the portion of the code to quote him?  We were always under the assumption that a post dated check could clear when presented.

  U.S. economic activity for Q1 2008 grew at an annual rate of 0.9%, up from the first estimate of 0.6%.  One contributor to the increase in annualized GDP was the continued strength of exports which, helped by the weak dollar, made U.S. goods attractive overseas.  Although not technically a recession, the combined two-quarter GDP represents the slowest expansion rate in the last five years, and the slowdown is raising concerns.  Read more in this week's Baker Weekly.
