Over 100 Texas bankers and IBAT associate members and staff descended on the halls of Congress last week to brief lawmakers on issues of importance to community bankers.  Meetings were held with 30 of Texas' 32 Congressmen and both Senators Hutchison and Cornyn.
     Earlier in the week, IBAT and ICBA and other state community banking organizations scored a major victory when the House Leadership elected to pull a credit union bill from the House suspension calendar that would have allowed credit unions to expand their field of membership to "underserved" areas.  The bill will likely be reconsidered again soon so we must remain vigilant and be prepared to object with phone calls and other correspondence.
     House banking committee Chairman Barney Frank will be attempting to broker a bill between the banking and credit union interests that will allow for credit unions to expand their presence while providing some much needed regulatory relief for community banks.
     Stay tuned.  IBAT and ICBA will be monitoring these and other events closely.  Be watching for the photo essay that will chronicle our successful DC visit in future issues of the Independent Banker magazine.

Question:   Can the bank issue checks made payable jointly to the borrower and to the swimming pool contractor but retain the checks in a file at the bank while construction of the pool is being completed?  The loan documents are not structured for multiple advances.  In essence, the borrower will be charged interest on the full amount of the loan but will not have access or control of the proceeds.  Some of the lenders believe they remember a regulation which disallows a bank to charge interest on funds not given to the borrower.
