Closed Account Notification System
IBAT, with participation from the Texas Department of Banking (Department), held a teleconference on April 1, 2008, on the Closed Account Notification System (CANS). CANS is a fraud prevention system that was mandated by the Texas Legislature in the 2007 legislative session. More than 700 people participated in the call, which was free for any bank with a location in the state of Texas. Participants were given a legislative history, a review of new Chapter 35 of Title 7 of the Texas Administrative Code, followed by a question and answer session. Judging from the number and type of questions asked, Texas banks are getting up to speed on CANS very quickly.
If you have any issues with registering for CANS, please contact the Department at 877.276.5554. The Department also has resources and FAQs available on its website at www.banking.state.tx.us. Once you are at the Department homepage, just click on Banks and Holding Companies.

Question: I received a request from the Dept. of Human Services Adult Protective Services Division requesting financial info on one of our customers. She referred me to Chapter 48 of the Human Resources Code, sub 154 on Access to Records or Documents. Do you mind checking that out for me to see if it is legit and whether we need a subpoena or other document to be able to release this information.
